1. The matter was last heard on 15/12/2004 and reserved for orders. However, today the learned counsel for the appellant submitted an application dated 23/12/2004 seeking leave to withdraw the appeal. The application is taken on record. In these appeal proceedings an application had been filed by Mr. J. Balakumar which was numbered as 98 of 2004 requesting that he be impleaded as co-appellant. The learned counsel for Mr. J. Balakumar has also filed an application today withdrawing application No.98 of 2004. The learned counsel for the respondents has no objection.
2. In view of these developments the appeal No. 65 of 2003 and application No. 98 of 2004 are disposed of as withdrawn.
3. No order as to costs.
