1. The matter was last heard on 15/12/2004 and reserved for orders. However, today the learned counsel for the appellant has presented an application seeking leave to withdraw the appeal. The application is taken on record. The learned counsel for the respondents has no objection.
2. This appeal had been filed along with an application for condonation of delay which was numbered as 97 of 2004. We had not taken a decision on the condonation of this delay and the appeal had not yet been admitted. In view of today’s application, however, the appeal No. 274 of 2004 as well as the application No. 98 of 2004 are disposed of as withdrawn.
3. No order as to costs.
