The memorandum of appeal does not disclose the provision of law under which it has been filed. On a specific query made from the learned counsel for the appellant we are informed that this appeal has been filed under Section 15T of the Securities and Exchange Board of India Act, 1992 (for short “the Act”). An appeal under this provision could be filed only against an order passed by the Board or against an order made by an adjudicating officer under the aforesaid Act. In the present case no order has been passed by the Board which could adversely affect the interests of the appellant nor is there any order made by the adjudicating officer under the Act.  We are of the view that the present appeal is not maintainable and were inclined to dismiss the same on this ground but the learned counsel for the appellant prays that he may be allowed to withdraw the same.

Dismissed as withdrawn.
