Firstly, the Petitioner had participated in conciliation proceedings and thereafter in arbitration proceedings. It is in these circumstances that he now seeks the appointment of an Adjudicator under Section 15-I of the Securities and Exchange Board of India Act, 1992. Having elected his remedy it is now not open to the Petitioner to pray for the appointment of an Adjudicator.
The writ petition is dismissed.
