1. Heard the counsel for the appellant and the counsel for the respondent. It is a matter of regret that while we asked the parties to resolve their differences, an impugned order has been passed subsequently while the matter was pending. In the circumstances the learned counsel for the appellant has no alternative except to withdraw this appeal.
2. Accordingly, the appeal is dismissed as withdrawn. Liberty is granted to the appellant to challenge the impugned order. All contentions left open. No order as to costs.
